Private Client Terms of Engagement
Welcome to Aymer Maria’s Private Client experience. By proceeding with your bespoke commission and paying the design fee, you acknowledge and accept the following terms:
1. Overview
We are honoured to work with you to create a bespoke jewellery piece. These Terms of Engagement outline the process, responsibilities, and fees to ensure a smooth and transparent experience.
2. Definitions
In these Terms of Engagement, unless the context otherwise requires:
- “We”, “Us”, and “Aymer Maria” refer to Pantheon Design Limited T/A Aymer Maria.
- “You” and “Client” refer to the individual commissioning the bespoke piece.
- “Piece” or “Commission” refers to the bespoke jewellery item produced for the Client.
3. Scope of Work
We will design and produce a unique bespoke piece based on your design brief, consultations, and agreed specifications.
4. Design Fee
A non-refundable design fee of £500 (incl. VAT) is payable before detailed designs and CAD visuals are shared.
The fee is deductible from the final commission balance if you proceed to production.
If you do not proceed, the fee is retained to cover design time and sourcing efforts.
5. Design Process
Two rounds of design adjustments are included in the design fee.
Minor adjustments are accommodated within the fee; substantial changes may incur additional costs.
A wax model (optional) can be produced for an additional £200 (incl. VAT & shipping).
6. Stone Sourcing
Stones are sourced and presented for your approval where applicable.
Once approved, the stone is reserved exclusively for your piece at the agreed price.
7. Confirmation & Deposit
Upon final design approval, a 50% deposit is required to secure materials and begin production.
8. Completion & Final Payment
Upon completion, you will receive final imagery.
The remaining balance must be paid in full before collection or delivery.
Please allow an additional 2–3 business days after completion for internal content creation (product photography and videography).
9. Delivery or Collection
Upon receipt of full payment, your piece will be securely shipped or available for in-person collection.
You will receive luxury packaging, stone certifications, an SMO certification, a warranty, and care instructions as applicable.
10. Aftercare
Complimentary resizing (one-time), cleaning, and polishing are available within the first six months (where applicable).
11. Intellectual Property
All designs, sketches, CADs, and creative materials remain the intellectual property of Aymer Maria.
We may professionally photograph or create content featuring your commissioned piece once completed.
These images may be used across Aymer Maria’s marketing channels, including (but not limited to) our website, social media, brochures, press, and lookbooks.
Client names and personal details will not be disclosed without explicit permission.
If you would prefer your commission to remain entirely private, please inform us in writing at the time of confirming your final design.
12. Shipping, Taxes, and Duties
Domestic and international shipping options will be discussed and confirmed prior to dispatch. Secure, insured delivery is arranged at an additional cost, unless otherwise agreed in writing.
Clients are responsible for any applicable customs duties, VAT, import taxes, or other related charges incurred during shipment outside the United Kingdom.
Aymer Maria is not responsible for delays caused by customs clearance processes or carrier issues beyond our control.
13. Limitation of Liability
We take every reasonable care in the design, production, and delivery of your commission. However, except where prohibited by law, our liability is limited to the amount you have paid for the commission. We are not responsible for any indirect, incidental, or consequential losses.
14. Force Majeure
We are not liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, pandemic, labour strikes, or customs delays.
15. Entire Agreement
These Terms of Engagement constitute the entire agreement between Aymer Maria and the Client, and supersede any prior discussions, correspondence, or representations.
16. Cancellation Policy
Once production has commenced, commissions cannot be cancelled.
In rare cases, partial refunds may be considered at our sole discretion, less any non-recoverable costs.
17. Governing Law
These Terms are governed by the laws of England and Wales.
By proceeding with your commission and paying the design fee, you confirm your acceptance of these Terms of Engagement.
